Car Accident?

Hi everyone, In Nov. 07 my elderly mom was struck by a red light runner who was traveling 60 mph in a 35. He ran the light while texting on his phone. Her car (a Jaguar) was totaled (struck front, passenger) and sent into oncoming traffic (this is according to police reports, several witnesses& camera). She spent months in therapy with a fractured chest and numerous, extensive injuries. She received a check from her insurance; in which she purchased a used car. However, yesterday, her “excellent” lawyer out of DC sent a check of a little more than 1k (he himself had seemingly minimal fees). My question is: I have heard many conflicting advice on what to do, and what should have been done. Her medical bills are sky-high despite insurance and she missed months of work (unpaid). Is all this typical of such things? Sorry everyone as I am unfamiliar with such things. The driver at fault has insurance; shouldn’t she be compensated for her med bills, pain, missed work, etc. Thank you all.

    Yes, the other driver’s insurance is liable for all of her bills and whatnot. You need to get a lawyer that is willing to go after the insurance company, and possbily one that will sue the other driver personally.
    I myself was in an accident last month, also not at fault. But unfortunately for me, the other driver had no insurance and my insurance was crap. I have a personal injury lawyer that is suing my auto insurance for as much as possible. I also have a lawyer that is suing the other driver personally to compensate for the lost wages, pain, suffering, and additional medical bills.
    I would do a little reaserch and see if you can find a better lawyer as opposed to the one you have- doesnt seem like he’s very good.

    What state did this happen it? Some states have weird laws- PA & FL, are two of them… but hopefully it didn’t happen there…
    Yes, since the other driver has insurance, you need to call them and file a claim, if it hasn’t been filed already. If it has been filed, you need to call and see what’s going on. Since you mother has an atty, they cannot speak to her, so maybe she needs to fire the lawyer and do this herself. That company should take care of the med bills up to their policy limits. That means, if the other driver only has $25,000 in bodily injury, that is the most your mother can get.
