Got Into A Car Accident And Victim Says We Were Going 75mph At Time Of Collision Airbags Didn’t Deploy?

The victim says she was rear-ended at approx 75 mph on a cloudy wet and rainy day. she said we failed to travel at a reasonable speed and distance to react and stop to avoid the collision her car has minor damages but our truck was almost totaled. we had already begun to stop as she came to a sudden stop we could brake any faster and hit her but the airbags didn’t deploy and we werent injured at all. this makes no sense… she is suing for 30,000 for loss of property hospital and medical expenses general damage and property damage… what? crazy i think… i think we should sue her for brake checkin us…
but on the serious side what case would we have against her in our defense? what proof could there be? insurance is handling it but im curious. there’s no way we hit her at 75mph and walked away just fine… i think its a clean case of people trying to **** other people out of their hard earned money…

    Bottom line, you hit her. Pay up.
    And with both of you going the same direction the only speed that matters is the impact speed — if she was doing 60 and you were doing 70 the impact speed is 10 mph and I would only expect minor damage.

    Get a lawyer! Dont trust your insurance company to protect you – theyre just out to profit as much as possible, in the long run, from whoever they can profit..

    The insurance companies are pretty good at sniffing out fraud and inflated claims, so let them handle it.

    Your insurance company will protect you and if it’s a bogus claim, they’ll deny it. You can certainly counter-sue if it lands in court claiming she brake checked you and had no reason to brake when she did. As far as a defense, I can’t think of any. Braking checking can’t be proven. She could make up a reason for braking. But there’s no way she could know your speed, that sounds impossible for a car ahead to make that determination. She would have more then minor damage if you hit her at 75 mph, a lawyer (which your insurance would provide for free if it goes to court) would probably argue that.

    don’t worry about her claim the police and insurance companies have a fancy formula for determining speed at the time of impact… and they also have one for determining speed when brakes were applied.. if you have the OBD III computer in your vehicle it automatically records speed at the time of impact and 10 seconds prior.. from all this they can determine the vehicle’s speed and if / when you hit the brakes.. as for the lawsuit that is what the insurance is for.. and unfortunately that’s how people are anymore they want a bunch of money for the “pain and suffering” and lost time at work, vehicle damages etc. while they probably enjoyed a little time off but thats just me..

    She is just trying to make money off that situation. The police report will have all of the information as far as speed and damage estimates.
    If she was actually hit at the speed she claims, all of you would be in the hospital from the injuries, plus, the damage to her car will reflect the actual speed she was hit. The insurance companies will battle it out. however, let your insurance company know that the other party is suing you. Many insurance companies have their own attorneys that will represent you in a court of law. Perfectly sounds to me like she is using this situation to make a dollar.
