Will We Have Debt Collectors After Us?

My fiance and I are getting married in less than 2 months. He was rear ended at a red light (the other person was texting on his phone and traveling 40 mph) and is currently being treated (and we have a lawyer). He’s in so much pain that he’s on oxycodone and is attempting to go to work when the pain is not so bad (since we have a mortgage to pay and all).
I am very afraid that the people that hit us have minimum insurance coverage ($10k). We’ve been doing medical liens for our doctor visits. We do have medical insurance but they won’t pay anything until we make a try to make a settlement with the person that hit him.
If we sue them, and they declare backrupcy, will we have medical debt collectors coming after us or will that go away with the other person’s bankruptcy? We are paying every cent to try to knock out our student loans at super high interest rates…I have no idea what I would do if we would have to pay the entire cost of his upcoming surgury and treatments.
We are trying to get debt free and live a respectable life. We do not want to get rich from a settlement…simply pay for our losses.

Your creditors will continue to seek payment without regard to the lawsuit, bankruptcy, employment, unemployment or darn near anything else. When they agreed to provide medical care, they agreed to do so on condition that they get paid, not on condition that you get the money.

I would think that you could ask your lawyer for more information regarding the other persons bankrupcty. I was also in a car accident and the other person had paid my medical bills and I never heard anything else regarding them. Good luck.

I suggest you watch the Michael Moore documentary “Sicko”.

Bankruptcy may not discharge this person for this debt if you win in court. Since they were text messaging then it is negligent on their part. Also check in your state if text messaging while driving is illegal.
Also do you have uninsured/underinsured coverage on your policy? If so then your insurance will pick up part of the tab.
